PROCEEDINGS OF THE POLICE JURY, PARISH OF OUACHITA, STATE OF LOUISIANA, TAKEN AT A REGULAR MEETING HELD ON, MONDAY, AUGUST 7, 2023 AT 5:31 P.M.
The Police Jury of the Parish of Ouachita, State of Louisiana met in a regular session in the Ouachita Parish Police Jury Meeting Room, Police Jury Administrative Building, Monroe, Louisiana on Monday, August 7, 2023, at 5:31 p.m., and was duly convened by Mr. Shane Smiley, President.
The president gave the invocation and led the Pledge of Allegiance.

APPROVAL OF AGENDA:
The president asked if there were any additions or amendments to the agenda. Mr. Thompson asked to add Elbert Taylor as a visitor. Motion offered by Mr. Bratton, seconded by Mr. Hudson to approve the agenda as amended. Motion passed without opposition.
PUBLIC COMMENT PERIOD:
The president asked for public comments concerning any matters on the approved agenda. No one appeared to speak during the public comment period.
ADOPTION OF MINUTES:
A motion to adopt the minutes of the special called Police Jury meeting including the committee meetings held on June 21, 2023 was offered by Mr. Clampit, seconded by Mr. Thompson. Motion passed without opposition.

PUBLIC HEARINGS:
The president convened a public hearing on Ordinance No. 9461 An Ordinance to authorize an Act of Sale by the Parish of Ouachita to sell certain adjudicated properties (Parcels 16588 & 48963) by public auction; and, further providing with respect thereto. No one appeared to speak in favor of or against the ordinance. Motion offered by Mr. Clampit, seconded by Mr. Thompson to close the public hearing. Motion passed without opposition.
The president convened a public hearing on Ordinance No. 9462 An Ordinance providing for an annual revenue for the Parish of Ouachita, State of Louisiana, levying annual taxes for said purposes; and, further providing with respect thereto. No one appeared to speak in favor of or against the ordinance. Motion offered by Mr. Thompson, seconded by Mr. Hudson to close the public hearing. Motion passed without opposition.
The president convened a public hearing on Ordinance No. 9463 An Ordinance amending Section 14-1 of the Compiled Ordinances of the Ouachita Parish Police Jury, to decrease the speed limit for a portion of Camp Road to 35 mph; providing for a public hearing; and further providing with respect thereto. No one appeared to speak in favor of or against the ordinance. Motion offered by Mr. Clampit, seconded by Mr. Bratton to close the public hearing. Motion passed without opposition.
VISITORS:
The president recognized Lori Woodard with Woodard & Associates. Ms. Woodard reported that the Police Jury s year 2022 audit was submitted to the Legislative Auditor s Office on time, with an unmodified opinion, and no findings. A management letter gave two recommendations that all police jury vehicles have permanently attached decals or emblems per state law and police jury policy, and that the annual Schedule of Expenditures of Federal Awards (SEFA) be completed in a timelier manner.
The president recognized Tommy Walpole with the Animal Shelter Advisory Committee. Mr. Walpole stated that the Animal Shelter Advisory Committee is requesting that the Jury approve the Environmental Phase 1 test for the possible new shelter location north of Cheniere Lake Area 1. Mr. Clampit requested to take up this item as this time. Mr. Land asked for approval for Public Works to perform some of the work needed. Motion offered by Mr. Clampit, seconded by Mr. Bratton to approve the Environmental Phase 1 test and to approve Public Works to perform some of the work needed. Motion passed without opposition.
The president recognized Elbert Taylor, 608 Willet Place Boulevard, Monroe. Mr. Taylor spoke regarding road and drainage issues in Millhaven Estates. Mr. Smiley asked to take up Mr. Thompson s items at this time.
Mr. Thompson introduced the following ordinance.
ORDINANCE NO. 9465
AN ORDINANCE CREATING ROAD DISTRICT NO. 1 OF THE PARISH OF OUACHITA, STATE OF LOUISIANA TO ALSO BE KNOWN AS THE MILLHAVEN ESTATES ROAD DISTRICT ; AND, FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, property owners and residents of the residential areas sometimes referred to collectively as Millhaven Estates have requested that the Ouachita Parish Police Jury empower them to fund and direct the improvement of the public roads and related infrastructure in their own neighborhood;
WHEREAS, the laws of the State of Louisiana authorize parish governing authorities to create Road Districts comprised of specific territory within the parish and having the authority to do and perform all acts necessary and proper for the purpose of constructing, maintaining, and improving public roads, highways, and bridges within the territorial limits of the district including ditching and draining thereof.
WHEREAS, the Ouachita Parish Police Jury has heretofore given notice as required by law of its intent to create a Road District for the Millhaven Estates area in accordance with La. R.S. 48:571, et. seq., said District to encompass the following property:
That portion of Lot No. 5 of Killoden Subdivision as shown on the plat filed September 17, 1935, in Plat Book 5, Page 19 of the records of the Ouachita Parish Clerk of Court, that lies in Section 30, T18N, R5E and east of Bennett s Bayou, including, but not limited to, Willet Place Square, Willet Place Square Unit 2, and Millhaven Estates Units 1 10.
WHEREAS, the public roads in the Millhaven Estates area serve only the Millhaven Estates area and do not carry traffic travelling to or from other residential or commercial areas, making this the Millhaven Estates area particularly suited to the use of a Road District to undertake the maintenance and improvement of such roads; and,
WHEREAS, after a public hearing the Ouachita Parish Police Jury finds that the creation of a Road District in the area known generally as Millhaven Estates is in the public interest.
NOW, THEREFORE:
BE IT ORDAINED that the Ouachita Parish Police Jury does by these presents create Road District No. 1 of the Parish of Ouachita, State of Louisiana, said District to also be known as the Millhaven Estates Road District to include and encompass the following property:
That portion of Lot No. 5 of Killoden Subdivision as shown on the plat filed September 17, 1935, in Plat Book 5, Page 19 of the records of the Ouachita Parish Clerk of Court, that lies in Section 30, T18N, R5E and east of Bennett s Bayou, including, but not limited to, Willet Place Square, Willet Place Square Unit 2, and Millhaven Estates Units 1 10.
BE IT FURTHER ORDAINED, the boundary of this Road District is described as follows:
Begin at the northeast corner of Lot No. 5 of Killoden Subdivision as shown on the plat filed September 17, 1935, in Plat Book 5, Page 19 of the records of the Ouachita Parish Clerk of Court; thence run westerly along the north line of said Lot No. 5 to its intersection with the west line of Sec. 30, T18N, R5E; then run southerly along said west line of Sec. 30 to the centerline of Bennett s Bayou; thence run southerly along the centerline of Bennett s Bayou to its intersection with the south line of the above-described Lot No. 5 of Killoden Subdivision; thence run easterly along the south line of Lot No. 5 of Killoden Subdivision to the east line of said Lot No. 5; thence run northerly along the east line of the above-described Lot No. 5 of Killoden Subdivision to the northeast corner of said Lot No. 5 and the Point of Beginning;
BE IT FURTHER ORDAINED, this District shall have all power and authority afforded Road Districts under the laws of the State of Louisiana, including but not limited to La. R.S. 48:571, et seq. and shall be governed in the manner prescribed by such laws; and,
BE IT FURTHER ORDAINED that Notice of the Formation of this District be given by publication in accordance with law.

Chief Hemphill requested that the Jury enact a temporary burn ban due to dry conditions in the parish.
Mr. Clampit, seconded by Mr. Hudson offered the following ordinance for adoption.
ORDINANCE NO. 9466
AN ORDINANCE TO ENACT A TEMPORARY BAN ON THE OPEN-AIR BURNING OF TRASH, GARBAGE, LEAVES, LIMBS, BRANCHES, AND DEBRIS OF ANY KIND; AND FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, La. R.S. 33:1236(31) authorizes parish governing authorities such as the Ouachita Parish Police Jury to, inter alia, prohibit the burning of trash, garbage, leaves, limbs and branches, or debris of any kind;
WHEREAS, the present risk of grass and woods fires throughout Ouachita Parish warrants a local burn ban that may be effectively enforced by local officials;
WHEREAS, the Chief of the Ouachita Parish Fire Protection District No. 1 has recommended a local, temporary ban on outdoor burning to prevent a proliferation of grass fires and woods fires during the current dry weather conditions; and,
WHEREAS, the Ouachita Parish Police Jury finds that such a temporary ban on outdoor burning serves the interests of the citizens of Ouachita Parish by helping to reduce the risk posed to lives and property by the proliferation of grass and woods fires during the current dry weather conditions;
NOW, THEREFORE:
BE IT ORDAINED by the Ouachita Parish Police Jury in a legally called and assembled Regular Meeting held on August 7, 2023, that:
1. In the unincorporated areas of Ouachita Parish no person shall conduct the open air burning of any trash, garbage, leaves, limbs and branches, or debris of any kind.
2. This Ordinance shall be effective from the time of its adoption by the Ouachita Parish Police Jury until terminated.
3. This Ordinance shall not apply to any person conducting open air burning pursuant to a license or permit issued by the Louisiana Department of Agriculture and Forestry or the Louisiana Department of Environmental Quality.
4. Any person violating any provisions of this Ordinance shall be punished by a fine of up to Five Hundred ($500.00) Dollars or imprisoned for a term of not more than thirty (30) days.
5. As an alternative to any other available enforcement mechanism or procedure, this Ordinance may be enforced through an administrative adjudication by the Ouachita Parish Administrative Hearing Officer pursuant to La. R.S. 13:2575(B) and Ouachita Parish Police Jury Ordinance No. 8786 (Compiled Ordinances of Ouachita Parish, Section 1-26);
BE IT FURTHER ORDAINED that upon the written recommendation of the Chief of the Ouachita Parish Fire Protection District No. 1 the President of the Ouachita Parish Police Jury is hereby authorized to terminate the Temporary Burn Ban effected by this Ordinance. Said termination shall be made by a written Proclamation to be posted at the Ouachita Parish Courthouse, published in the Official Journal, and distributed to local media outlets;
BE IT FURTHER ORDAINED that a copy of this Ordinance be forwarded to the Sheriff of Ouachita Parish; the Constables of Ouachita Parish; the Ouachita Parish Fire Department; the City Marshal of West Monroe; the City Marshal of Monroe; and, the News Media in Ouachita Parish.

Ms. Rider requested approval of an alternate aerial contract in view of the current unavailability of the primary contractor. Motion offered by Mr. Thompson, seconded by Mr. Clampit to approve the alternate aerial contract. Motion passed without opposition.

The chair recognized Mr. Murray, Public Works. Mr. Murray asked to pull the item regarding Logtown School monument from the agenda.
Mr. Murray presented a request for a fire hydrant variance for Harrell Road Storage. Motion offered by Mr. Clampit, seconded by Mr. Thompson to approve the fire hydrant variance. Motion passed without opposition.

The president reconvened the regular Police Jury meeting at 6:17 p.m.
Motion offered by Mr. Thompson, seconded by Mr. Clampit to ratify and adopt all actions taken in the committee meetings. Motion passed without opposition.
MOTIONS * ORDINANCES * RESOLUTIONS:
The president stated that Mr. Robinson was not at the meeting and that he would take up his items.
Mr Smiley asked Mr. Crosby for an update on Cerdan Circle drainage. Mr. Crosby explained that the issue of sinkholes caused by failures of enclosed drainage pipes was not limited to Cerdan Circle but was present in other areas of the subdivision. Mr. Crosby stated that the preliminary estimate to replace the failed drainage pipes is $2,000,000.00.
Mr Smiley asked Mr. Crosby for an update on Hodge Watson Road. Mr. Crosby presented the options for the repairs. The estimate for the southwest end is $1,119,000.00, the estimate for the northeast end is $1,523,000.00 and the estimate for patching the middle section is $600,000.00. The estimate for a total rebuild for the middle section is $2,474,000.00. The northeast end has the highest average daily traffic.

AN ORDINANCE PROVIDING FOR AN ANNUAL REVENUE FOR THE PARISH OF OUACHITA, STATE OF LOUISIANA, LEVYING ANNUAL TAXES FOR SAID PURPOSES; AND, FURTHER PROVIDING WITH RESPECT THERETO.

BE IT ORDAINED, by the Ouachita Parish Police Jury, acting in accordance with law as the governing authority of Ouachita Parish, Louisiana and certain taxing districts located therein, in a public meeting held on August 7, 2023, which meeting was conducted in accordance with the Open Meetings Law and the additional requirements of Article VII, Section 23(C) of the Louisiana Constitution and R.S. 47:1705(B), that said Ouachita Parish Police Jury voted to increase the millage rate(s), but not in excess of the prior year s maximum rate(s), on all taxable property shown on the official assessment roll for the year 2023, and when collected, the revenues from said taxes shall be used only for the specific purposes for which said taxes have been levied. Mr. Crosby stated that the cost estimate to replace the existing pipes, add an additional line under I-20 to loop the system, adding needed valves, etc. is $1,500,000.00, which includes the engineering fee. Motion offered by Mr. Clampit, seconded by Mr. Hudson to allocate $1,320,000.00 from the ARPA funds for the construction and to pay the engineering fee from the ARPA interest funds. WHEREAS, presently the speed limit in effect for that portion of Camp Road is 45 miles per hour;
WHEREAS, the Ouachita Parish Public Works Department has indicated that conditions along the southern portion of Camp Road warrant a reduction of the speed limit to 35 miles per hour to promote safe and efficient travel; and,
WHEREAS, the Ouachita Parish Police Jury finds that a reduction of the speed limit on a portion of Camp Road is in the public interest;
NOW, THEREFORE:

Mr. Mitchell requested that the agenda be amended to take action on a franchise ordinance for NortheastTel. Mr. Bratton also asked to add an item under Mr. Smiley s name for Chenault Aviation and Military Museum. Both items were inadvertently left off the agenda and this was not realized earlier in the meeting when the agenda was approved. Action on these items was needed before the next meeting in order to not delay the projects. Motion offered by Mr. Bratton, seconded by Mr. Hudson to amend the agenda. ORDINANCE NO. 9467
AN ORDINANCE GRANTING A NON-EXCLUSIVE FRANCHISE TO NORTHEAST LOUISIANA TELEPHONE COMPANY (HEREINAFTER NortheastTel ); AND FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, a non-exclusive franchise is hereby granted to NORTHEAST LOUISIANA TELEPHONE CO. ( NortheastTel ) by the Parish of Ouachita, which franchisee is granted the right to use and occupy the streets, public ways, and places of the parish for the installation, operation and maintenance of the equipment and plant of a community internet and telephone communication system for a period of fifteen (15) years, beginning on August 1, 2023, and ending on July 31, 2038.
NOW, THEREFORE:
Section 1. BE IT ORDAINED by the Ouachita Parish Police Jury, in regular and legal session that in consideration of the faithful performance and observance of the conditions and reservations hereinafter specified, NortheastTel, its successors, or assigns provided such successors, assigns or designees are approved by the Ouachita Parish Police Jury, hereinafter referred to as the company is hereby granted the right to erect, maintain and operate telephone and/or internet transmission and distribution facilities and additions thereto, in, under, over, along, across, and upon the streets, lanes, avenues, sidewalks, alley ways, bridges and other public places in the Parish of Ouachita outside of incorporated municipalities, for the purpose of transmission and distribution of telephone/internet impulses and energy for a period of fifteen (15) years from August 1, 2023.
Section 2. BE IT FURTHER ORDAINED that in this section, the word telephone or internet shall mean a system for transmission of electronic and or light signals and audio by coaxial or fiber optic cable or future technology serving like purpose.
Section 3. BE IT FURTHER ORDAINED that any poles used for the company s distribution system shall be those erected and maintained by the present utility companies authorized by franchise to conduct their business with the Parish of Ouachita, when and where practical, providing mutually satisfactory rental agreements can be entered into with said companies. Where the use of poles, owned by the utility companies are not practicable or mutually satisfactory or rental agreements cannot be entered into with said companies, the company with the prior written consent of the Ouachita Parish Police Jury, through its Public Works Director, shall have the right to erect and maintain its own poles as may be necessary for the proper construction and maintenance of the transmission and distribution system, the location of the poles to be approved by the parish. Construction permits shall be obtained from the parish prior to any construction in parish right-of-way.
Section 4. BE IT FURTHER ORDAINED that the company s transmission and distribution system poles, wires and appurtenances shall be located, erected and maintained so as not to endanger or interfere with the lives of persons or to interfere with any improvements that this parish may deem proper to make, or to unnecessarily hinder or obstruct the free use of the streets, alleys, bridges, or other public properties; removal of poles to avoid such interference will be at the company s expense.
Section 5. BE IT FURTHER ORDAINED that construction and maintenance of the transmission and distribution system, including house connections, shall be in accordance with the provisions of applicable laws and regulations of the State of Louisiana affecting such electrical installations which may be presently in effect, or changed by future legislation or rule-making.
Section 6. BE IT FURTHER ORDAINED that installations and housetop hardware shall be uniform throughout the parish, except that the company shall be free to change its hardware and installation procedures as the art progresses.
Section 7. BE IT FURTHER ORDAINED that installation shall be maintained so as not to create electrical interference with telephone, internet or television services already in existence.
Section 8. BE IT FURTHER ORDAINED that in the maintenance and operating of its transmission and distribution system in the streets, alleys, or other public places, and in the course of any new construction or addition to its facilities, the company shall proceed so as to cause the least possible inconvenience to the general public; any opening or obstruction in the streets or other public places, made by the company in the course of its operation, shall be guarded and protected at all times by the placement of adequate barriers, fences, or boardings, the bounds of which during periods of dusk and darkness shall be clearly designated by red or amber warning lights.
Section 9. BE IT FURTHER ORDAINED that the company shall indemnify and hold the parish harmless at all times during the term of this grant from and against all claims for injury or damages to persons or property both real and personal caused by the construction, erection, operation or maintenance of any structure, equipment, appliance or products authorized or used pursuant to the authority of this section.
Section 10. BE IT FURTHER ORDAINED that the company shall carry insurance in such form and in such companies as shall be approved by the parish, to protect the parish and itself from and against any and all claims for injury or damages to persons or property, both real and personal, caused by the construction, erection, operation or maintenance of any structure, equipment, appliance or products authorized for use pursuant to authority of this section, and the amount of such insurance against liability due to damage to property shall not be less than one hundred thousand ($100,000.00) as to any one person and two hundred thousand dollars ($200,000.00) as to any one accident, and against liability due to injury or death of persons, one hundred thousand dollars ($100,000.00) as to any one person and three hundred thousand dollars ($300,000.00) as to any one accident.
Section 11. BE IT FURTHER ORDAINED that the company, upon receipt of due notice and in writing from the parish, shall defend at its own expense any action or proceeding against the parish in which it is claimed that the injury or damage arose from the company s activities in the operation of this television system.
Section 12. BE IT FURTHER ORDAINED that the distribution system of the company installed or to be hereafter installed shall not be abandoned in whole or in part without the consent of the Ouachita Parish Police Jury.
Section 13. BE IT FURTHER ORDAINED that the company shall have a published telephone number, and be so operated that complaints and requests for repairs or adjustments may be received during usual business hours. The company shall respond to all service calls within twenty-four (24) hours and shall correct malfunctions as promptly as possible, but, in all events, within seventy-two (72) hours after thereof.
Section 14. BE IT FURTHER ORDAINED that the Ouachita Parish Police Jury reserves the right to collect a franchise fee from the company in the event modifications of the rules and regulations of the Federal Communication Commission governing cable television (47 CFR Section 76) allow franchise fees to be charged to franchisees providing services the company provides through this franchise. Any such franchise fee shall not exceed five percent (5%) of the company s gross revenues , as that term is defined by the Consumer Choice for Television Act of 2008 (See La. R.S. 45:1363). derived from the company s operations subject to this franchise.
Section 15. BE IT FURTHER ORDAINED that the company shall give the Ouachita Parish Police Jury at least sixty (60) days written notice prior to any increase in charges to its subscribers.
Section 16. BE IT FURTHER ORDAINED that if the company shall fail to comply with any of the provisions of the grant or default in any of its obligations except for cause beyond the reasonable control of the company, and shall fail within thirty (30) days of written notice from the parish to correct such default non-compliance, then the Ouachita Parish Police Jury shall have the right to revoke this grant and all rights of the company hereunder.
Section 17. BE IT FURTHER ORDAINED that at the time this franchise becomes effective the company shall furnish a bond to the parish in the amount of ten thousand ($10,000.00), in such form and with such sureties as shall be acceptable to the parish, guaranteeing the payment of all sums, which may at any time become due from the company to the parish under the terms of this franchise agreement, except such sums as are covered by the insurance provided in subsection (i) and further guaranteeing the faithful performance of all the obligations of the company under the terms of this franchise.
Section 18. BE IT FURTHER ORDAINED that should any section, clause, or provision of this section be declared invalid by a court of record, the same shall not affect the validity of the section as a whole or any part thereof, other than the part so declared invalid.
