PROCEEDINGS OF THE POLICE JURY, PARISH OF OUACHITA, STATE OF LOUISIANA, TAKEN AT A REGULAR MEETING HELD ON, MONDAY, DECEMBER 18, 2023 AT 5:28 P.M.
The Police Jury of the Parish of Ouachita, State of Louisiana met in a regular session in the Ouachita Parish Police Jury Meeting Room, Police Jury Administrative Building, Monroe, Louisiana on Monday, December 18, 2023, at 5:28 p.m., and was duly convened by Mr. Shane Smiley, President.
Mr. Hudson gave the invocation and led the Pledge of Allegiance.

APPROVAL OF AGENDA:
The president asked if there were any additions or amendments to the agenda. Mr. Mitchell asked to add two alcohol renewal applications to the agenda. These were received after the agenda was published and action was needed before the next meeting of the Jury. Motion offered by Mr. Thompson, seconded by Mr. Clampit to approve the agenda as amended. Motion passed without opposition.
PUBLIC COMMENT PERIOD:
The president asked for public comments concerning any matters on the approved agenda. No one appeared or came forth to speak during this time.
ADOPTION OF MINUTES:
A motion to adopt the minutes of the regular Police Jury meeting including the committee meetings held on December 4, 2023 and the minutes of the Finance Committee meetings held on November 6, 2023 and November 27, 2023 was offered by Mr. Clampit, seconded by Mr. Hudson. Motion passed with Mr. Robinson abstaining.
PUBLIC HEARINGS:
The president convened a public hearing on Ordinance No. 9475 An Ordinance to authorize an Act of Sale by the Parish of Ouachita to sell certain adjudicated properties (Parcels 59550, 38764, 57023, 69898, 39492, 103914 & 85045) by public auction; and, further providing with respect thereto. No one appeared to speak in favor of or against the ordinance. Mr. Mitchell asked to remove parcel 39492 since the structure had burned. Motion offered by Mr. Thompson, seconded by Mr. Clampit to close the public hearing. Motion passed without opposition.
The president convened a public hearing on Ordinance No. 9476 An Ordinance amending Ordinance No. 9441 annual operating budget for general fund, special revenue funds, debt service funds, and capital projects funds for the year, 2023. No one appeared to speak in favor of or against the ordinance. Motion offered by Mr. Hudson, seconded by Mr. Robinson to close the public hearing. Motion passed without opposition.
The president convened a public hearing on Ordinance No. 9477 An Ordinance adopting operating budgets of revenue and expenditures for the fiscal year beginning January 1, 2024 and ending December 31, 2024, for general fund, special revenue funds, debt service funds, and capital projects funds. No one appeared to speak in favor of or against the ordinance. Motion offered by Mr. Clampit, seconded by Mr. Thompson to close the public hearing. Motion passed without opposition.
VISITORS:
The president recognized Melissa Saye with the Children s Museum. Ms. Saye thanked the Jury for their support of the new museum.
The president recognized Sheila Kay Downhour with Ouachita Green. Ms. Downhour thanked the Jury for their support for Ouachita Green and gave an update on recent events.
ENGINEERING REPORT:
The president recognized Mr. Crosby, Engineer. Mr. Crosby asked to defer Old Natchitoches Road to the next agenda.
Mr. Crosby recommended approval of the substantial completion of the Shady Lane drainage project. Motion offered by Mr. Hudson, seconded by Mr. Bratton to accept the substantial completion. Motion passed without opposition.
Mr. Crosby recommended approval of the substantial completion of the Chadwick Drive project. Motion offered by Mr. Thompson, seconded by Mr. Clampit to accept the substantial completion. Motion passed without opposition.
Mr. Crosby presented Change Order No. 1 for Ed Edelen Road and recommended approval. Motion offered by Mr. Thompson, seconded by Mr. Hudson to approve Change Order No. 1. Motion passed without opposition.
Mr. Crosby presented Change Order No. 5 for Stubbs Vinson Road and recommended approval. Motion offered by Mr. Thompson, seconded by Mr. Hudson to approve Change Order No. 5. Motion passed without opposition.

FINANCE COMMITTEE MEETING
The president called the Finance Committee meeting to order at 5:58 p.m.
The president recognized Mr. Cammack, Treasurer. Mr. Cammack presented the claim statement for the period of November 22, 2023 through December 14, 2023 and recommended approval. Motion offered by Mr. Thompson, seconded by Mr. Hudson to approve payment of the claims for the period stated as recommended by the treasurer. Motion passed without opposition.
Mr. Cammack presented budget versus actual statements to the Jury. No action was needed.
Mr. Cammack presented the credit/debit card receipt policy and requested approval. Motion offered by Mr. Bratton, seconded by Mr. Hudson to approve the credit/debit card receipt policy. Motion passed without opposition.
There being no further business to come before this committee, a motion to adjourn and reconvene the regular meeting was offered by Mr. Smiley, seconded by Mr. Clampit. Motion passed without opposition. The finance committee meeting was adjourned at 5:59 p.m.

RESOLUTION NO. 23-61
A RESOLUTION AUTHORIZING THE ISSUANCE OF A CERTIFICATE OF SUBSTANTIAL COMPLETION FOR THE WALL WILLIAMS PROJECT (STATE PROJECT NO. H.013804); AND, FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, the Parish Engineer has advised that the Wall Williams project (State Project No. H.013804) has reached substantial completion;
NOW, THEREFORE:
BE IT RESOLVED that the Ouachita Parish Police Jury does hereby authorize the President to execute a Certificate of Substantial Completion for the Wall Williams project and to take such other actions as are necessary in connection therewith.

SECTION TWO: The adoption of this Operating Budget expenditures be and the same is hereby declared to operate as an appropriation of the amount therein set forth within the terms of the budget classifications.
SECTION THREE: Amounts are available for expenditures only to the extent included within the 2024 budgets.
BE IT FURTHER ORDAINED that the Treasurer for the Ouachita Parish Police Jury, be and hereby is authorized and empowered to make line item changes within each Budget classification without approval by the Ouachita Parish Police Jury, as long as such line item changes do not increase the total amount of budgeted expenditures within a departmental classification. Any amendment of the Budgets which would increase departmental classifications in excess of the total amount budgeted for expenditures shall be reserved solely to the Ouachita Parish Police Jury.

RESOLUTION NO. 23-64
A RESOLUTION REQUESTING THAT KANSAS CITY SOUTHERN RAILROAD INSTALL SIGNALS AND GATES AT THE RAIL CROSSING OF CHENIERE BAPTIST CHURCH ROAD; AND, FURTHER PROVIDING WITH RESPECT THERETO
WHEREAS, Cheniere Baptist Church Road cannot be closed as it provides the only means of ingress and egress to Cheniere Baptist Church and to homes, a business and properties to the east of said church;
WHEREAS, evaluation and analysis has shown that extending Cheniere Baptist Church road to the west along the north side of the Kansas City Southern Railroad to connect with Cheniere Station Road is not feasible due to the cost of constructing such an extension, which would require significant embankment and culverts/bridge to cross a wetland and bridge;
WHEREAS, there exists no reasonable option for closing the crossing of Cheniere Baptist Church Road over the Kansas City Southern Railroad; and,
WHEREAS, the installation of lighted signals and gates at said crossing appears to be the most reasonable safety improvement available for that crossing;
NOW, THEREFORE:
BE IT RESOLVED that the Ouachita Parish Police Jury requests that Kansas City Southern Railroad proceed with all due haste to install lighted signals and gates at the railroad crossing of Cheniere Baptist Church Road;
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Louisiana Department of Transportation and Development as a request for any and all assistance that the State of Louisiana can provide in obtaining lighted signals and gates at the railroad crossing of Cheniere Baptist Church Road; and,
BE IT FURTHER RESOLVED that in conjunction with this request the Ouachita Parish Police Jury will install and/or maintain appropriate pavement markings and advance warning signs at said railroad crossing.

MR. LARRY BRATTON, DISTRICT C:
Mr. Bratton, seconded by Mr. Robinson offered the following resolution for adoption.
RESOLUTION NO. 23-63
A RESOLUTION AUTHORIZING A THREE PERCENT (3%) COST-OF-LIVING AND OTHER PAY INCREASES FOR OUACHITA PARISH POLICE JURY EMPLOYEES; AND, FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, when finances allow, the OPPJ desires that the effective pay of OPPJ employees continues to at least keep pace with inflation;
WHEREAS, the past two years have brought rates of inflation not seen in decades; and,
WHEREAS, while the OPPJ cannot provide a pay increase to match the present rate of inflation it nonetheless recognizes the benefit of providing a general pay increase to help off-set the increasing cost-of-living;
NOW, THEREFORE:
BE IT RESOLVED by the OPPJ in legal and regular session that, except as set forth below, a three percent (3%) cost-of-living pay increase be implemented for those employees whose rate of pay is determined by the OPPJ, effective at the commencement of the pay period beginning December 25, 2023;
BE IT FURTHER RESOLVED by the OPPJ in legal and regular session that, except as set forth below, a three percent (3%) cost-of-living pay increase be implemented for the Registrar of Voters employees whose rate of pay is determined by the OPPJ, effective at the commencement of the pay period beginning December 25, 2023;
BE IT FURTHER RESOLVED by the OPPJ in legal and regular session that the Justices of the Peace and the Constables pay as is determined by the OPPJ be increased by fifty dollars ($50.00) per month, effective at the commencement of the pay period beginning December 25, 2023;
BE IT FURTHER RESOLVED by the OPPJ in legal and regular session that a three percent (3%) annual pay increase for OPFD employees shall be implemented, effective at the commencement of the pay period beginning December 25, 2023, said increase being intended to satisfy the mandate of La. R.S. 33:1992(B) requiring an annual two percent (2%) pay increase for each member of the Fire Department;
BE IT FURTHER RESOLVED that with respect to those employees whose rate of pay is determined by a separate governing authority, namely employees of the Ouachita Parish Public Library and the Ouachita Parish Mosquito Abatement District, the rate and effective date of any cost-of-living increase or other pay adjustment shall be as determined by their respective governing authorities;
BE IT FURTHER RESOLVED that neither the cost-of-living increase nor any other additional increase set forth above shall be afforded to any employee with a rate of pay determined by the Ouachita Parish Police Jury who has been granted a pay increase for the same position within 180 days prior to December 31, 2023, or a pay increase as a result of a promotion or change of position within the said 180 day period, or newly hired within the last 180 days, provided however that this provision shall not apply to employees expressly exempted from this limitation at the time the OPPJ approved their pay increase, promotion or change of position. However, this limitation shall not apply to employees of Ouachita Parish Fire Protection District No. 1 as their compensation is generally governed by state law and the current Working Agreement.

MR. SHANE SMILEY, DISTRICT E:
Motion offered by Mr. Smiley, seconded by Mr. Clampit to approve the Save on Specialty Prescription program. Motion passed without opposition.
Mr. Smiley presented changes to Section 5.5 of the Police Jury personnel manual regarding retiree health insurance benefits. The revised Section 5.5 is detailed below. Motion offered by Mr. Smiley, second by Mr. Bratton to adopt changes to retiree health insurance benefits and revise Section 5.5 of the personnel manual to reflect the changes.
SECTION 5.5 — PAYROLL DEDUCTIONS
C. Hospitalization Insurance: All full-time employees, spouses without access to health coverage through an employer, and their dependent children, all employees who have retired from employment after January 1, 1987, spouses without access to health coverage through an employer, and their dependent children, are eligible for coverage under the parish group hospitalization insurance program. To obtain coverage each employee must meet the requirements set forth by the insurer. Employees are not required to participate in the group insurance plan, which shall be administered by the Human Resources Department. The Police Jury shall contribute a fixed percentage of the premium for all full-time employees and all retired employees who retire after January 1, 1987, until said retired employee reaches the earlier of the age of sixty-five (65) or eligible for Medicare. Retired employee s spouse, without access to health coverage through an employer, can continue to be eligible for coverage until the earlier of the age of sixty-five (65) or eligible for Medicare and dependents will continue to be eligible for coverage as applicable to the terms of the insurance under contract.
For employees retiring on or after January 1, 2024 the following Years of Service provisions apply:
30 YEARS OF SERVICE The Police Jury percentage for the employee and eligible spouse will be the fixed percentage of the current employer rate. The Police Jury percentage for dependent children will be 0% of the dependent child premium.
25 YEARS OF SERVICE – The Police Jury percentage for the employee will be the fixed percentage of the current employer rate. The Police Jury percentage for an eligible spouse will be at 50% of the spousal premium. The Police Jury percentage for dependent children will be 0% of the dependent child premium.
20 YEARS OF SERVICE – The Police Jury percentage for the employee will be 50% of the current health insurance total premium. The Police Jury percentage for an eligible spouse and dependent children will be at 0% of the spousal and/or dependent child premium.
15 YEARS OF SERVICE – The Police Jury percentage for the employee will be 25% of the current health insurance total premium. The Police Jury percentage for an eligible spouse and dependent children will be at 0% of the spousal and/or dependent child premium.
10 YEARS OF SERVICE – The Police Jury percentage for the employee, spouse, and dependent children will be 0% of the current health insurance total premium.
This Retiree Years of Service provision will not apply to: (1) any employee that is currently participating in the Deferred Retirement Opportunity Program (DROP) (2) has completed DROP and continued working (3) any employee that is within 3 years of their retirement eligibility as of January 1, 2024.
The spouse of an employee, or a retired employee after November 6, 2023, that has access to health coverage through another employer is ineligible for OPPJ Health Coverage. A spouse of a retiree, that was married to the employee prior to retirement, and was previously ineligible for OPPJ Health Coverage and loses employer health coverage, can be added to a retiree health policy, subject to the Years of Service Provision above.

WHEREAS, the Ouachita Parish Police Jury recognizes the threat that natural hazards pose to people and property within Ouachita Parish, Louisiana;;
WHEREAS, the Ouachita Parish Office of Homeland Security and Emergency Preparedness has prepared a multi-hazard mitigation plan, hereby known as the 2023 Ouachita Parish Multi-Jurisdictional Hazard Mitigation Plan Update (dated August 25, 2023) in accordance with the Disaster Mitigation Act of 2000;
WHEREAS, the 2023 Ouachita Parish Multi-Jurisdictional Hazard Mitigation Plan Update (dated August 25, 2023) identifies mitigation goals and actions to reduce or eliminate long-term risk to people and property in Ouachita Parish from the impacts of future hazards and disasters; and,
WHEREAS, adoption by the Ouachita Parish Police Jury demonstrates their commitment to the hazard mitigation and achieving the goals outlined in the 2023 Ouachita Parish Multi-Jurisdictional Hazard Mitigation Plan Update (dated August 25, 2023);

A RESOLUTION AUTHORIZING AN AMENDMENT TO THE WORKING AGREEMENT BETWEEN THE OUACHITA PARISH POLICE JURY AND THE OUACHITA PARISH FIREFIGHTERS ASSOCIATION LOCAL 1694 ( WORKING AGREEMENT ) TO PROVIDE FOR AN INCREASE TO THE BASE PAY; AND, FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, the Ouachita Parish Police Jury ( OPPJ ), acting in its statutory capacity as the Board of Commissioners of Fire Protection District No. 1 of Ouachita Parish has determined that an increase in the compensation paid to certain employees of said District is in order; and,
WHEREAS, the OPPJ desires to authorize an amendment to the Working Agreement and/or such other actions are reasonable and necessary to implement such an increase;
NOW, THEREFORE:
BE IT RESOLVED by the OPPJ in legal and regular session that the minimum monthly salary of a fireman as set forth in Section XV(1) of the Working Agreement be increased by $100.00/month, from its present level of $2,250.00/month to $2,350.00/month;
BE IT FURTHER RESOLVED that the pay increase set forth above shall become effective upon the commencement of the first pay period following the Ouachita Parish Firefighters Association s approval of an amendment to the Working Agreement adopting the increase set forth above; and.
BE IT FURTHER RESOLVED that the President of the Ouachita Parish Police Jury be, and hereby is, authorized to execute an amendment to the Working Agreement, and such other documents as are reasonable and necessary, to give effect to this Resolution.
