 NOTICE is hereby given that a Regular Public Hearing will be held by the Monroe Planning Commission for the City of Monroe on Monday, August 4, 2014 in the Council Chambers, First Floor, City Hall, Monroe, Louisiana at 5:30 p.m. to consider the following cases:

 ADVERTISEMENT FOR BIDS

Separate sealed BIDS for the construction of Wastewater System Improvements Program – Basin MR-04/05/07 (A)2 Rehabilitation will be received by the City of Monroe, at the Office of the City Engineer, located at 3901 Jackson Street, Monroe, Louisiana 71202.  Bids will be received until 1:45 P.M., on   August 19, 2014 .   Bids will be publicly opened and read in the Office of the City Engineer, at the above mentioned address, at 2:00 P.M.

Bids received after the 1:45 p.m. deadline will be returned to the bidder unopened.

Description of Basic Work:

All work for the project shall be installed and constructed in accordance with the Contract Documents prepared by Denmon Engineering. The proposed improvements will be awarded and constructed under a single construction contract. Independent bids shall be submitted for all work related to furnishing, delivering, and installing all materials, equipment, labor and services required to:

Base Bid:
Replace approximately 33,878 L.F. of 6-inch and 8-inch sanitary sewer using pipe bursting; replace approximately 3,880 L.F. of 10-inch sanitary sewer using pipe bursting; replace approximately 1290 L.F. of 12-inch sanitary sewer using pipe bursting; install 33 new manholes, perform open-cut replacement and point repairs; determine & replace existing active service laterals on pipe bursted segments, and all else incidental thereto.

Additive Alternate #1
Rehabilitate existing Pargoud Lift Station by installing a new Gorman-Rupp self-priming package pump station, new discharge piping, removing existing discharge piping, electrical upgrades, concrete slab, and all else incidental thereto.

Additive Alternate #2
Installation of approximately 875 L.F. of 8-inch sanitary sewer using horizontal directional drilling; abandon existing sewer line in place, plug existing 8-in sewer line with non-shrink grout at ends and at all old service wyes; install 3 new manholes, remove and replace 1 existing manhole, determine & replace existing active service laterals, installation of service wyes and all else incidental thereto.

Bids must be submitted on forms provided, must be prepared in accordance with the "Project Specifications” and must include all information required by the bid form.  Failure to comply with these requirements will result in rejection of the bids.  Bid forms will not be issued later than 24 hours prior to the hour and date set for opening bids.

Drawings, specifications and contract documents were prepared by Denmon Engineering, P.O. Box 8460, Monroe, Louisiana 71211.  The bid package may be examined in the office of Denmon Engineering, 114 Venable Lane, Monroe, Louisiana 71203.

Copies of the CONTRACT DOCUMENTS may be obtained at the office of Denmon Engineering, located at 114 Venable Lane, Monroe, Louisiana, upon receipt of a $100 deposit for each set.  Bona fide prime contractors who submit a valid bid for the project will receive a full refund for their first set of Contract Documents upon returning them in good condition within ten calendar days of the bid opening. The deposit for all other plans will be non-refundable.

Each proposal shall be accompanied by Bid Bond, a Cashier’s Check for Certified Check in the amount not less than that specified above and shall be made payable to the City of Monroe, without conditions.  This shall be given as a guarantee that the Bidder will execute the Contract, if it be awarded to him, in conformity with the contract documents.

The successful Bidder to whom the contract is awarded will be required to furnish a performance and payment bond acceptable to the City of Monroe, in the amount of one hundred percent (100%) of the contract in conformity with the Contract Documents.  The contractor for the contract shall purchase and maintain such insurance as will protect him/Owner from claims which may arise out of, or result from the contractor’s execution of the work, whether such execution be by himself or by any subcontractor or by anyone directly or indirectly employed by any of them or by anyone from whose acts any of them may be liable.

The Bidder will be required to comply with the requirements of Title VI of the Civil Rights Act of 1964, The Federal Labor Standards Provisions 29 CFR Parts 1-5 (Davis Bacon and Related Acts), Section 503/504 of the Rehabilitation Act of 1973, and local City Resolution No. 7311 for submittal of Affirmative Action Program prior to contract award.

REQUIRED LANGUAGE IN PUBLISHED ADVERTISEMENT FOR BIDS
 FOR AIP CONSTRUCTION CONTRACTS

a. Required Language In Published Advertisements For Bids For All AIP Contracts:

(1)  Policy.  It is the policy of the Department of Transportation (DOT) that disadvantaged business enterprises as defined in 49 CFR Part 26 shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds.

(2)  Buy American Provision.

The proposed contract is subject to the Buy American provision under Section 9129 of the Aviation Safety and Capacity Expansion Act of 1990.  Details of such requirement are contained in the Specifications.

b. Additional Language Required In Published Advertisement For Bids For AIP Contracts Where The Sponsor Has A DBE Program In Effect Or Is Required By 49 CFR Part 26 To Have An Approved DBE Program.

All bidders and proposers shall make good faith efforts, as defined in Appendix A of 49 CFR Part 26, Regulations of the Office of the Secretary of Transportation, to subcontract   3%  of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals (DBE).  In the event that the bidder for this solicitation qualifies as a DBE, the contract goal shall be deemed to have been met.  Individuals who are reputably presumed to be socially and economically disadvantaged include women, Blacks, Hispanics, Native Americans, Asian-Pacific Americans and Asian-Indian Americans.  The apparent successful bidder (Proposer) will be required to submit information concerning the DBE’s that will participate in this contract.  The information will include the name and address for each DBE, a description of the work to be performed by each named firm, and the dollar value of the contract (Subcontract).  If the bidder fails to achieve the contract goal as stated herein, it will be required to provide documentation demonstrating that it made good faith efforts in attempting to do so.  A bid that fails to meet these requirements will be considered non-responsive.

c. Required Notices For Contracts Over $10,000.

The regulations and orders of the Secretary of Labor, OFCCP and FAR 152.61 require that the sponsor or his contractor(s) include, in invitation for bids or negotiations for contracts over $10,000, the following notices:

(1) The proposed contract is under and subject to Executive Order 11246 of September 24, 1965, and to the Equal Opportunity Clause.  The Bidder’s (Proposer’s) attention is called to the "Equal Opportunity Clause” and the "Standard Federal Equal Employment Opportunity Construction Contract Specifications” set forth in the Specifications.

(2) The Bidder (Proposer) must supply all the information required by the bid or proposal form.

(3) The successful bidder will be required to submit a Certification of Non-segregated Facilities prior to award of the contract, and to notify prospective subcontractors of the requirement for such a Certification where the amount of the subcontract exceeds $10,000.  Samples of the Certification and Notice to Subcontractors appear in the Specifications.

(4) Women will be afforded equal opportunity in all areas of employment.  However, the employment of women shall not diminish the standards or requirements for the employment of minorities.

d. Contracts In Excess Of $50,000.

In the invitation for bids relating to contracts of $50,000 or more, the sponsor shall include the following notice:

For contracts of $50,000 or more, a contractor having 50 or more employees, and his subcontractors have 50 or more employees and who may be awarded a subcontract of $50,000 or more, will be required to maintain an affirmative action program within 120 days of the commencement of the contract.

c. Additional Notices For $1 Million Contracts.

For each contract which may result in a bid of $1 million or more, the invitation for bids shall also include the following notices:

(1) Pre-award Equal Opportunity Compliance Reviews:  Where the bid of the apparent low responsible bidder is in the amount of $1 million or more, the bidder and his known all-tier subcontractors which will be awarded subcontracts of $1 million or more will be subject to full on-site, pre-award equal opportunity compliance reviews before the award of the contract for the purpose of determining whether the bidder and his subcontractors are able to comply with the provisions of the equal opportunity clause.

(2) Compliance Reports:  Within 30 days after award of this contract, the contractor shall file a compliance report (Standard Form 100) if:

(a) The contractor has not submitted a complete compliance report within 12 months preceding the date of award; and

(b) The contractor is within the definition of "employer” in Paragraphs 2e (3) of the instructions included in Standard Form 100.

(3) The contractor shall require the subcontractor on all-tier subcontracts, irrespective of dollar amount, to file Standard Form 100 within 30 days after award of the subcontract if the above two conditions apply.  Standard Form 100 will be furnished upon request.

Liquidated damages for delay will be in the amount of eight hundred twenty five dollars ($825.00) per day for delays other than those caused by adverse weather conditions, acts of God, acts of delay caused by scheduling of operation by the Engineer or the Owner adverse to the interest of the contractor.

Bidders are notified that the award of the contract shall be by the Owner and that construction administration and inspection will be performed by the Engineer and final acceptance will be made by the Owner upon recommendation of the Engineers and subject to approval by the FAA.

Bids must be submitted on the Standard Form of Proposal included herein and the successful bidder will be required to execute the Owner’s Standard Form of Contract for Construction, together with the performance bond, within ten (10) days after formal award of the contract.  No bids may be withdrawn for a period of sixty (60) days after the time schedule for the opening of bids.

The City reserves the right to reject bids and waive informalities.

The contractor is cautioned that the award of this contract is dependent upon the availability of Federal matching funds.  Should Federal funds not become available within the time allowed for the award of the contract, the owner reserves the right to reject any and all bids.

The contractor shall display his Contractor’s License Number prominently on the outside of the envelope.

At the time and place stipulated, all proposals on hand will be opened and read aloud.

Any proposal received after the specified day and hour will be returned unopened.

No bids, after being submitted, may be withdrawn after the scheduled time for opening of bids.

Contract Goals

The City of Bastrop will use contract goals to meet any portion of the overall goal that the recipient does not project being able to meet using RN means.  Contract goals are established so that, over the period to which the overall goal applies, they will cumulatively result in meeting any portion of the recipient’s overall goal that is not projected to be met through the use of RN means.

The City of Bastrop will establish contract goals only on those DOT-assisted contracts that have subcontracting possibilities.  It need not establish a contract goal on every such contract, and the size of the contract goals will be adapted to the circumstances of each such contract (e.g., type and location of work and availability of DBE’s to perform the particular type of work).

We will express our contract goals as a percentage of the total amount of DOT-assisted contracts.
