     NOTICE is hereby given that a public hearing will be held on the following ordinance, Tuesday, January 28, 2014, at 6:00 p.m., in the Council Chamber at Monroe City Hall:

Ordinance authorizing James E. Mayo, Mayor, to transfer by donation one (1) 1996 Ford Crown Victoria to the Creola, LA Police Department, Creola, LA and further providing with respect thereto. (MPD)

      NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of Monroe, Louisiana, on the 28th  day of  January , 2014 in the Council Chamber, City Hall Building, beginning at 6:00 p.m., to consider the following proposed amendment to the Zoning Map:(This item was passed over at the last meeting.)
     
An amendment to the Zoning Map to rezone an existing 1.42 acre tract from B-2 Neighborhood Business District to an R-MD Medium Density Residential District presently located in Ouachita Parish and more particularly described as follows:

ORDINANCE

STATE OF LOUISIANA

CITY OF MONROE                                                   NO. 11,449  

 The following Ordinance was introduced by Mrs. Ezernack_______who moved for its adoption and was seconded by Dr. Armstrong_______:

AN ORDINANCE AMENDING CHAPTER 30.5 ENTITLED SMOKE-FREE AIR ACT, SECTION 30.5-7 ENTITLED PROHIBITION OF SMOKING IN OUTDOOR PUBLIC PLACES AND FURTHER PROVIDING WITH RESPECT THERETO:

 WHEREAS, the Monroe City Council  adopted a new Chapter 30.5 entitled Smoke-Free Air Act the State of Louisiana Plumbing Code; and

 WHEREAS, after discussion with a representative from the Louisiana Campaign for Tobacco-Free Living and businesses in the City of Monroe who need clarification on certain issues the following changes are hereby recommended for approval.
 
NOW THEREFORE BE IT ORDAINED by the City Council of the City of
 Monroe, Louisiana, in legal session convened, that Chapter 30.5-7 of the Monroe City Code should be amended as follows:
 
Sec. 30.5-7. Prohibition of Smoking in Outdoor Public Places.

 Smoking shall be prohibited in the following outdoor places:

A. Within a reasonable distance of at least 5 feet outside the main entrance,
operable windows, and ventilation systems of enclosed areas where smoking is as to prevent tobacco smoke from entering those areas.
           
C.      In and within 5 feet of outdoor serving areas of restaurants and bars
           wherein an outdoor service station is located and an employee is stationed
           at the location so would be subjected to prolonged exposure to secondhand smoke.

 All other provisions of Sec. 30-5-7 shall remain as originally stated.

This Ordinance having been introduced on the 10th  day of December, 2013.

ORDINANCE

CITY OF MONROE

 The following Ordinance was introduced by  Ezernack   who moved for its adoption and was seconded by  Armstrong.

AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF A DONANTION FROM THE FORT MIRO CHAPTER, NATIONAL SOCIETY OF THE DAUGHTERS OF THE AMERICAN REVOLUTION OF A WORLD WAR II MEMORIAL ON THE GROUNDS OF MONROE CITY HALL AND FURTHER PROVIDING WITH RESPECT THERETO:

 WHEREAS, in honor of those fighting for America’s freedoms the City of Monroe has dedicated a portion of the grounds at Monroe City Hall to memorialize those who have fought and sacrificed from Ouachita Parish; and

 WHEREAS, the Fort Miro Chapter, National Society of the Daughters of the American Revolution have asked to donate and place on the dedicated portion of the grounds at Monroe City Hall a memorial to those who fought in World War II which denotes the known names of those who perished from Ouachita Parish, Louisiana.

 NOW, THEREFORE, BE IT ORDAINED:

 That the City of Monroe does hereby accept the donation of a memorial from the Fort Miro Chapter, National Society of the Daughters of the American Revolution honoring those who fought in World War II and denotes the known names of those who perished from Ouachita Parish.

      This Ordinance having been introduced on the  10th      day of  December, 2013.

       The following Ordinance was offered by Mrs.  Ezernack   who moved for its adoption and was seconded by Ms.  Blakes:

AN ORDINANCE TO RENAME AN EXISTING STREET NAME FROM FERRAND STREET TO ARMAND CONNECTOR. THIS CHANGE WILL OCCUR FROM ARMAND STREET TO STERLINGTON ROAD (AN APPROXIMATE 1,605 SECTION) AND FURTHER PROVIDING WITH RESPECT THERETO:

 WHEREAS, the City of Monroe has requested the renaming of a 1,605 foot section of Ferrand Street from the intersection of Armand Street to the intersection of Sterlington Road. This section of Ferrand Street is located north of the Arkansas, Louisiana, Mississippi Railroad and west of Sterlington Road, and
 
 WHEREAS, this area has been a part of the Tower-Armand Connector street widening project, which is scheduled for completion sometime in the Spring and as part of this project the intersection of Armand and Ferrand Streets will be reconfigured and Ferrand Street will be reoriented. As a result, maintaining the street name along this section may provide some confusion to motorists and public safety vehicles. Planning and Zoning Division staff along with Engineering Department met to discuss various options for this situation. It was decided that this option would affect the least amount of property owners and would be the least confusing.
 
 WHEREAS, the City of Monroe Planning Commission has recommended that this request be approved, with a 3-2-1 vote.

 NOW, THEREFORE

 BE IT ORDAINED by the City Council of the City of Monroe, in legal session convened, that the 1,605 foot section of Ferrand Street from Armand Street to Sterlington Road, is hereby changed to Armand Connector.
 
 This ordinance was INTRODUCED on the 10th day of December, 2013.

       This Ordinance having been submitted in writing, introduced and published was then submitted to a final vote as a whole, the vote thereon being as follows:

EMERGENCY ORDINANCE

 The following Ordinance was introduced by Dr.  Armstrong   who moved for its adoption and was seconded by Mrs.  Ezernack:

AN EMERGENCY ORDINANCE DECLARING THE NEED FOR IMMEDIATE REPAIRS TO THE EXISTING 27 INCH SEWER MAIN BETWEEN GRAMMONT STREET AND OUACHITA AVE. AND FURTHER PROVIDING WITH RESPECT THERETO:

 WHEREAS, the 27 inch gravity sewer main located between Grammont Street and Ouachita Avenue has collapsed; and

 WHEREAS, this sewer main lies immediately adjacent to the Kansas City Southern railway line and its collapse causes concerns for the safe travel of trains carrying commercial material; and

      WHEREAS, the collapse of this sewer main and the subsequent collapse of the railway system would cause an immediate threat to property in the area; and
     
      WHEREAS, repair to the system has already been undertaken.

 NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that the situation with the 27 inch gravity sewer main located between Grammont Street and Ouachita Avenue poses  a danger to life and property loss and is hereby declared an emergency.

 BE IT FURTHER ORDAINED  that such emergency repairs as are necessary to repair the sewer main are hereby authorized and approved and the Mayor of the City of Monroe is authorized to enter into such contracts as may be necessary to complete the project.

 This Ordinance having been submitted in writing and was then submitted to a vote as a whole, the vote thereon being as follows:

 AYES:  Council Members Armstrong, Ezernack, Blakes, Wilson & Clark

 NAYS: NONE.

Sealed bids will be received by the City of Monroe, (herein called the Owner), at the Purchasing Division, conference room address: 1014 Grammont Street, Monroe, Louisiana until  1:45 PM  on February 11, 2014  at which time and place the bids will be publicly opened at 2:00 PM , and read and taken under advisement.

There will be a Pre-Bid meeting on February 5, 2014 at 10:00 AM at the Monroe Masur Museum.
