The following resolution was offered by Wilson and seconded by Blakes:
RESOLUTION NO. 6157                              .

A RESOLUTION PROVIDING FOR CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE SPECIAL ELECTION IN THE CITY OF MONROE, STATE OF LOUISIANA, ON SATURDAY, NOVEMBER 16, 2013, TO AUTHORIZE THE CONTINUATION OF THE LEVY AND COLLECTION OF SPECIAL TAXES THEREIN AND TO AUTHORIZE THE CITY OF MONROE TO AMEND ITS CHARTER ESTABLISHING LIMITATIONS AS TO THE TERM OF OFFICE FOR ALL CITY COUNCIL DISTRICTS AND THE OFFICE OF THE MAYOR.

BE IT RESOLVED by the City Council of the City of Monroe, Parish of Ouachita, State of Louisiana, acting as the governing authority (the "Governing Authority”) of the City of Monroe, Parish of Ouachita, State of Louisiana (the "City”), that:
SECTION 1.  Canvass.  This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the City on SATURDAY, NOVEMBER 16, 2013, to authorize the continuation of the levy and collection of special taxes therein, and to authorize the City  to amend its charter establishing limitations as to the term of office for all City Council Districts and the office of the Mayor limiting the office holder to no more than three (3) consecutive terms, such limitations to take place following the present term of such elected officials within the City, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.
SECTION 2.  Procès Verbal.  A Procès Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Ouachita, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.
SECTION 3.  Promulgation of Election Result.  The result of said election shall be promulgated by publication in the manner provided by law.
 This resolution having been submitted to a vote, the vote thereon was as follows:

YEAS:  Council members Armstrong, Ezernack, Blakes, Wilson & Clark 
NAYS:  None 

ABSENT:  None 

 And the resolution was declared adopted on this, the 26th day of November, 2013.

PROCÈS VERBAL AND PROCLAMATION OF THE CANVASS OF THE VOTES CAST AT THE SPECIAL ELECTION HELD FOR THE CITY OF MONROE, PARISH OF OUACHITA, STATE OF LOUISIANA, ON SATURDAY, NOVEMBER 16, 2013.

BE IT KNOWN AND REMEMBERED that on November 26, 2013, at six o’clock (6:00) p.m., at its regular meeting place, City Hall, Monroe, Louisiana, the City Council of the City of Monroe, Parish of Ouachita, State of Louisiana, acting as the governing authority (the "Governing Authority”) of the  City of Monroe, Parish of Ouachita, State of Louisiana (the "City”), and being the authority ordering the special election held therein on Saturday, November 16, 2013, did, in open and public session, examine the official certified tabulations of votes cast at the said election, and did examine and canvass the returns of the said election, there having been submitted at said election the following propositions, to wit:

CITY OF MONROE TAX PROPOSITIONS
PROPOSITION NO. 1
(RECREATION FACILITIES - CONTINUATION)

Shall the City of Monroe, State of Louisiana (the "City”), acting under the authority of Article VI, Section 30 and 32 of the Constitution of the State of Louisiana, be authorized to continue to levy a special tax of one and eighty-eight hundredths (1.88) mills tax on all property subject to taxation in the City, said mills to represent a 0.15 mills increase over the 1.73 mills tax authorized to be levied through the year 2013 pursuant to an election held on November 15, 2003 (an estimated $734,445.69 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2014 and ending with the year 2023, for the purpose of maintaining and operating the recreational facilities of the City?

PROPOSITION NO. 2
(SAFETY SERVICES-CONTINUATION)

Shall the City of Monroe, State of Louisiana (the "City”), acting under the authority of Article VI, Section 30 and 32 of the Constitution of the State of Louisiana, be authorized to continue to levy a special tax of one and six hundredths (1.06) mills tax on all property subject to taxation in the City, said mills to represent a 0.08 mills increase over the .98 mills tax authorized to be levied through the year 2013 pursuant to an election held on November 15, 2003 (an estimated $414,102.35 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2014 and ending with the year 2023, for the purpose of providing municipal public safety services in the City and maintaining and operating municipal service departments in connection therewith, including the acquisition of necessary equipment?

PROPOSITION NO. 3
(DRAINAGE FACILITIES - CONTINUATION)

Shall the City of Monroe, State of Louisiana (the "City”), acting under the authority of Article VI, Section 30 and 32 of the Constitution of the State of Louisiana, be authorized to continue to levy a special tax of one and thirty-one hundredths (1.31) mills tax on all property subject to taxation in the City, said mills to represent a 0.10 mills increase over the 1.21 mills tax authorized to be levied through the year 2013 pursuant to an election held on November 15, 2003 (an estimated $511,768.00 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2014 and ending with the year 2023, for the purpose of  operating and maintaining drainage facilities of the City?

PROPOSITION NO. 4
(CHARTER AMENDMENT – TERM LIMITS – CITY COUNCIL)

Shall the Home Rule Charter and Plan of Government for the City of Monroe, Louisiana, be amended pursuant to Article VI of the Constitution of the State of Louisiana and Article VII, Section 7-04 of the Home Rule Charter of the City of Monroe, by adding Section 2-01G. to the Home Rule Charter of the City of Monroe, Louisiana, to provide that no person shall be eligible for election to the City Council for more than three (3) consecutive terms said term limit to be applied prospectively following the term of the Councilmen elected in the 2012 election?

PROPOSITION NO. 5
(CHARTER AMENDMENT – TERM LIMITS - MAYOR)

Shall the Home Rule Charter and Plan of Government for the City of Monroe, Louisiana, be amended pursuant to Article VI of the Constitution of the State of Louisiana and Article VII, Section 7-04 of the Home Rule Charter of the City of Monroe, by adding Section 3-03C. to the Home Rule Charter of the City of Monroe, Louisiana, to provide that no person shall be eligible for election to the Office of Mayor for more than three (3) consecutive terms said term limit to be applied prospectively following the term of the Mayor elected in the 2012 election?


 

Attached as Exhibit A to, and included in, this Proces Verbal is a copy of the Notice of Special Election and proof of publication of such notice.

There was found by said count and canvass that the following votes had been cast at the said special election IN FAVOR OF and AGAINST, respectively, the propositions as hereinabove set forth at the following polling places, to-wit:

PROPOSITION NO. 1

The polling places above specified being the only polling places designated at which to hold the said election, it was therefore shown that there were a total of 4,411 votes cast IN FAVOR OF Proposition No. 1 and a total of 1,903 votes cast AGAINST Proposition No. 1, as hereinabove set forth, and that there was a majority of 69.86% votes cast FOR Proposition No. 1 as hereinabove set forth.  PROPOSITION NO. 1 DULY CARRIED.

PROPOSITION NO. 2

The polling places above specified being the only polling places designated at which to hold the said election, it was therefore shown that there were a total of 4,542 votes cast IN FAVOR OF Proposition No. 2 and a total of 1,683 votes cast AGAINST Proposition No. 2, as hereinabove set forth, and that there was a majority of 72.96% votes cast FOR Proposition No. 2 as hereinabove set forth.  PROPOSITION NO. 2 DULY CARRIED.

PROPOSITION NO. 3

The polling places above specified being the only polling places designated at which to hold the said election, it was therefore shown that there were a total of 4,767 votes cast IN FAVOR OF Proposition No. 3 and a total of 1,495 votes cast AGAINST Proposition No. 3, as hereinabove set forth, and that there was a majority of 76.13% votes cast FOR Proposition No. 3 as hereinabove set forth.  PROPOSITION NO. 3 DULY CARRIED.

PROPOSITION NO. 4

The polling places above specified being the only polling places designated at which to hold the said election, it was therefore shown that there were a total of 4,956 votes cast IN FAVOR OF Proposition No. 4 and a total of 1,272 votes cast AGAINST Proposition No. 4, as hereinabove set forth, and that there was a majority of 79.58% votes cast FOR Proposition No. 4 as hereinabove set forth.  PROPOSITION NO. 4 DULY CARRIED.

PROPOSITION NO. 5

The polling places above specified being the only polling places designated at which to hold the said election, it was therefore shown that there were a total of 4,917 votes cast IN FAVOR OF Proposition No. 5 and a total of 1,392 votes cast AGAINST Proposition No. 5, as hereinabove set forth, and that there was a majority of 77.94% votes cast FOR Proposition No. 5 as hereinabove set forth.  PROPOSITION NO. 5 DULY CARRIED.

Therefore, the Governing Authority did declare and proclaim and does hereby declare and proclaim in open and public session that Proposition No. 1, Proposition No. 2, Proposition No. 3, Proposition No. 4, and Proposition No. 5 as hereinabove set forth each were DULY APPROVED by a majority of the votes cast by the qualified electors voting at the said special election held in the City on Saturday, November 16, 2013.

THUS DONE and signed at Monroe, Louisiana, on the 26th day of November, 2013.
